Distance Selling Contract

DISTANCE SALE AGREEMENT
1. PARTIES

BUYER
The person placing an order via www.yunuskoruyucu.com.
The buyer’s name, surname, address, telephone number and email address as provided at the time of ordering shall be deemed valid.

2. SUBJECT
MATTER The subject matter of this contract is to define the rights and obligations of the parties regarding the sale and delivery of the product or products ordered by the Buyer electronically via the www.yunuskoruyucu.com website.

3. PRODUCT AND PAYMENT DETAILS
The
type,
quantity,
make and model,
sale price,
total amount including VAT,
and
delivery charge of the products covered by the order are as specified on the order screen.
By confirming the order, the Buyer is deemed to have accepted this information.

4. DELIVERY
The products shall be dispatched to the address provided by the Buyer at the time of ordering as soon as possible, subject to stock availability and logistical conditions.
Delivery shall be carried out via a courier company.
The Seller shall not be held liable for any delays arising from the Buyer providing an incorrect or incomplete address.

5. DELIVERY INSPECTION
The Buyer is obliged to inspect the delivery packaging before accepting the product.
Damaged parcels must not be accepted, and a damage report must be drawn up by the courier.
Claims for damage without a report may not be accepted.

6. CANCELLATION AND RETURN POLICY
Orders may only be cancelled before the product is dispatched.
YunusKoruyucu products are professional electronic equipment designed for use in marine environments;
returns will not be accepted for products where the packaging has been opened,
the product has been assembled,
tested,
used or
submerged
in water.
As the product’s usage history and technical condition cannot be verified retrospectively, used products are not considered suitable for resale.

7. WARRANTY TERMS
Products sold are covered by a 1 (one) year warranty from the date of delivery.
The warranty covers only manufacturing and material defects.
The following situations are excluded from the warranty:
user errors,
unauthorised intervention or repairs,
physical damage,
damage to cables and connections,
incorrect connection and unsuitable supply voltage,
and natural disasters.

8. FORCE
MAJEURE Neither party shall be held liable for failure to fulfil contractual obligations due to natural disasters, war, strikes, transport disruptions, decisions by public authorities, or events beyond the parties’ control.

9. CONFIDENTIALITY
Information shared by the Buyer shall be processed and protected in accordance with applicable legislation.
Such information shall not be disclosed to third parties except where required by law.

10. EVIDENCE AGREEMENT
The parties agree that, in the event of any disputes arising from this contract, the Seller’s electronic records, order records, system records and commercial ledgers shall constitute evidence.

11. RESOLUTION
OF DISPUTES The laws of the Republic of Turkey shall govern the interpretation and enforcement of this contract.
Disputes shall be resolved in accordance with the provisions of applicable legislation.

12. ENTRY
INTO FORCE By confirming the order via the website, the Buyer declares that they have read, understood and accepted all the provisions of this Distance Selling Contract.
This contract shall enter into force upon completion of the order.
