PRE-CONTRACTUAL INFORMATION FORM (CONSUMER PROTECTION NOTICE)

2. BUYER INFORMATION
The name, delivery address, phone number and e-mail address you provide at checkout will be used. This information will be included in the personalised document sent to you once your order is completed.

3. PRODUCT AND PRICE INFORMATION
The essential characteristics, quantity, and total sale price (all taxes included) of the ordered electronic dolphin repeller devices, chargers, mounting accessories or parts are listed specifically for your order in your cart and order summary.

Instalment Interest: Any instalment interest rates applied by the BUYER's own bank are displayed on the payment screen; the SELLER does not apply any additional interest or deferred-payment charges.

4. DELIVERY AND PERFORMANCE INFORMATION
Delivery Time: The product will be delivered within the committed period, not exceeding the statutory 30-day limit, depending on the distance to the BUYER's location.
Carrier: Domestic orders are shipped via the SELLER's contracted carrier; international orders are shipped via a contracted international carrier under the Turkish Micro-Export (ETGB) scheme.
Customs Duties (International Orders): International shipments are subject to DAP (Delivered at Place) terms. Any customs duty, import charge or local VAT levied under the customs regulations of the buyer's country is entirely the BUYER's responsibility.

5. RIGHT OF WITHDRAWAL - CONDITIONS OF USE
Period: The BUYER (individual consumer) has the right to withdraw from the contract within 14 (fourteen) days from the delivery of the product to themselves or to a third party at the address they specify, without giving any reason and without paying any penalty.
Notification: To exercise the right of withdrawal, a clear written notice must be given to the SELLER within this period, either by phone at 0532 340 26 52 or by e-mail at info@yunuskoruyucu.com, or via a durable medium.
Return Shipping Cost: If a product that fully qualifies for withdrawal is returned via the SELLER's contracted carrier, the return shipping cost is borne by the SELLER. If a different carrier is used, the cost is borne by the BUYER.

6. SITUATIONS WHERE THE RIGHT OF WITHDRAWAL DOES NOT APPLY (COMMERCIAL AND TECHNICAL RETURN RESTRICTIONS)
Due to the underwater-technology and marine-electronics nature of the products and their IP68 waterproofing standards, the right of withdrawal and discretionary return absolutely does not apply in the following cases:

6.1. Commercial and Professional Purchases: If the order is placed for commercial or professional purposes, the transaction does not fall within the scope of Turkish Consumer Law No. 6502, and there is legally no right of withdrawal or discretionary return. Such purchases are governed by the Turkish Commercial Code.
6.2. Packaging and Sealing Exception: Due to the nature of Dolpinger® acoustic devices, once the protective box packaging, vacuum seal, waterproofing tape, or the security/warranty seals on the box have been opened, the right of withdrawal is entirely extinguished, pursuant to Article 15(ç) of the Turkish Distance Contracts Regulation.
6.3. Seawater Exposure and Loss of Resale Value: If the device is removed from its box, mounting accessories are used, the device is exposed to seawater/salt water, or it is operated underwater; the BUYER COMPLETELY LOSES THE RIGHT OF WITHDRAWAL AND RETURN, as the product can no longer be resold as new.

7. WARRANTY AND REPLACEMENT
The purchased Dolpinger® acoustic dolphin repeller devices are covered by a like-for-like replacement warranty for 1 year from the delivery date against technical malfunctions that may occur at sea. Corrosion, physical impact, unauthorised service intervention and user errors contrary to the user manual are excluded from the warranty.

8. COMPLAINTS AND COMPETENT AUTHORITIES
The BUYER may apply to the Consumer Arbitration Committees or Consumer Courts at their place of residence or where the transaction took place, within the monetary limits determined annually by the Turkish Ministry of Trade. For commercial purchases, the sole competent authority is the İstanbul (Anadolu) Courts and Enforcement Offices.

9. DECLARATION OF ACCEPTANCE
The BUYER declares and acknowledges that they have read all the provisions set out in this Pre-Contractual Information Form, that they fully understand the commercial/technical return restrictions applicable to marine electronics products, that they are fully informed about the essential characteristics, price, payment and delivery conditions of the product sold, and that they have given the required consent electronically.
